Acknowledgment of Participation and Itinerary. Parent/Guardian acknowledges and agrees that their Student will voluntarily participate in the Tour, which includes multi-day travel to multiple cities and states. The Company reserves the right to adjust the Tour itinerary at its sole discretion due to logistical or safety concerns. Parent/Guardian agrees to ensure the Student complies with all changes.

Medical Treatment Authorization. Parent/Guardian authorizes the Company, its employees, Escorts, or Designees to secure medical treatment for the Student in the event of an emergency. Parent/Guardian agrees to be solely responsible for all related costs. Parent/Guardian will provide accurate medical and emergency contact information for the Student in advance.

Assumption of Risk. Parent/Guardian acknowledges the inherent risks associated with group travel for their Student, including but not limited to transportation incidents, illness, accidents, civil unrest, natural disasters, or acts of terrorism. Parent/Guardian understands and assumes all such risks knowingly and voluntarily on behalf of their Student. This includes any injury or loss sustained while the Student is interacting with third-party vendors or during off-itinerary excursions.

Third-Party Service Providers. Parent/Guardian understands that the Company is not the owner or operator of any transportation, accommodation, restaurant, or venue services and serves solely as a coordinator. Therefore, the Company shall not be liable for acts or omissions of any third-party providers.

Release and Waiver of Liability. To the fullest extent permitted under Ohio law, including Ohio Revised Code § 2305.10, Parent/Guardian, on behalf of their Student, releases and waives any and all claims against The Heritage Tours, LLC, its officers, directors, agents, employees, Escorts, Designees, contractors, and volunteers for personal injury, property loss, delay, or any damages arising out of or connected with the Student's participation in the Tour, except where caused by the gross negligence or willful misconduct of the Company.

Behavior and Dismissal of Student. Parent/Guardian agrees to ensure that the Student acts respectfully and in accordance with all instructions issued by the Company or its representatives. Disruptive conduct by the Student (including intoxication, harassment, violence, theft, or refusal to comply with rules) will result in immediate removal of the Student from the Tour. Parent/Guardian shall bear full responsibility for all resulting expenses.

Financial Responsibility for Damages Caused by Student. Parent/Guardian accepts full liability for any damage caused by the Student's actions to persons or property during the Tour and agrees to indemnify and hold harmless the Company and its affiliates from any resulting claims, liabilities, and legal costs, including attorney's fees.

Photo and Video Release. Parent/Guardian grants the Company an irrevocable, royalty-free license to use any photographic, video, or audio recordings taken of the Student during the Tour for promotional or educational purposes in all forms of media, without compensation.

Force Majeure. The Company shall not be liable for delay, cancellation, or failure to perform due to force majeure, including but not limited to natural disasters, pandemics, war, terrorism, government restrictions, labor strikes, or any event beyond the Company’s control.

Modification of Itinerary. Company may cancel or alter any aspect of the Tour itinerary due to operational needs, safety concerns, or circumstances beyond its control. Additional expenses incurred due to such changes are the sole responsibility of the Parent/Guardian.

Non-Refundable Portions and Student Termination. Tour fees are non-refundable for any unused portion if the Student is unable to attend or is removed from the Tour. The Student may be removed from the Tour at any time for behavior deemed detrimental to the safety or enjoyment of others. No refund shall be issued for such removal.

Travel Insurance. The Company does not provide insurance coverage for the Student. Parent/Guardian is solely responsible for obtaining personal travel insurance for the Student for medical emergencies, baggage, and trip interruption or cancellation.

Limitation of Liability. In no event shall the Company be liable for indirect, incidental, punitive, or consequential damages arising from the Student's participation in the Tour, regardless of the theory of liability, even if advised of the possibility of such damages.

Governing Law and Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio. Any disputes shall be brought in the appropriate state or federal court in Franklin County, Ohio.

Binding Effect. This Agreement is binding upon the Parent/Guardian and their heirs, executors, administrators, successors, and assigns, and extends to the Student as the intended beneficiary of the releases and waivers contained herein.

Entire Agreement and Acknowledgment. This Agreement constitutes the entire understanding between the parties. By registering their Student for, allowing their Student to attend, or permitting their Student to participate in any aspect of the Tour (including scholarship or guest participation), Parent/Guardian agrees to all terms herein on behalf of the Student. Parent/Guardian affirms they are the legal parent or guardian of the Student and have the legal authority to execute this Agreement on the Student's behalf.
